Limited Warranty

Emaldo ApS (hereinafter referred to as "Emaldo") warrants that, subject to the exclusions and limitations set forth herein, Emaldo products will perform in accordance with the specifications and limitations detailed on the respective product data sheets.

1. WARRANTY

1.1.   Emaldo warrants that its products shall conform to the individual product specifications and shall be free from defects or faults.

1.2.   Emaldo will only be obliged to rectify defects or non-conformities that occur within the warranty period of the products as specified on the respective data sheets.

1.3.   In addition to the standard limited warranty of each product, Emaldo also offers a warranty extension option for all energy storage systems purchased through authorized distribution channels. For the warranty extension price list, please visit www.emaldo.com or look in your Emaldo App.

1.4.   Emaldo Products and systems can only be installed by certified personnel or third-party installers. Only people with the required local certifications, e.g. certified installer, and that have completed the necessary Emaldo training are considered certified installers.

2. CLAIMS & REMEDY

2.1.   In the event of any defects or non-conformities, customer shall notify their installer within 2 weeks of the occurrence of the issue and provide reasonable evidence of the alleged defect. If claims are not made within 2 weeks of the occurrence, Emaldo will consider you to have waived your right to make a warranty claim.

2.2.   Emaldo shall have a reasonable period to rectify the issue or replace the defective products and reserves the right to arrange an onsite inspection if required.

2.3.   For the installer to determine whether the issue relates to the Emaldo Equipment or the installation itself, customers should supply the following information when making a claim:

  • Information about all defective products, including product model number, serial number, date of installation, and date of failure.
  • Installation information, including make, model, and quantity of photovoltaic panels.
  • Error messages on the screen (if applicable) and description of the faults / errors.
  • Original proof of purchase of the energy storage system.

2.4.   If a claim is received during the warranty period and a product failure covered by the warranty is found, Emaldo may, at its sole discretion, choose to solve it in one of the following ways:

  • Fix the problem by changing the configuration or updating software.
  • Repair the product by replacing spare parts.
  • Exchange the product for a new or refurbished product that is at least functionally equivalent to the original product, or for an upgraded model that is functionally equivalent or better than the original product.

2.5.   If the unit is replaced during the warranty period, the remainder of the warranty period will automatically be transferred to the replacement unit.

2.6.   If it is proven that the problem was caused by an incorrect installation, Emaldo reserves the right to contact the original installer and ask them to solve the issue. If the original installer fails to solve the issue, subsequent charges may be billed to the original installer.

2.7.   Emaldo reserves the right to charge a handling fee if a product is found not to be covered by this limited warranty.

2.8.   Replaced products will become the property of Emaldo and shall be returned to Emaldo. Instruction for returning of products will be given to the Customer via the claim procedure.

2.9.   If the Customer does not return the allegedly defective product within 4 weeks of receipt of the replacement unit, or no damage is found after inspection of the returned product, Emaldo will invoice the Customer for the replacement, delivery, and admin costs.

3. COVERAGE AND WARRANTY EXCLUSION

3.1.   The Emaldo Limited Warranty only covers the cost of hardware materials required to bring the device back into operation.

3.2.   The Emaldo Limited Warranty does not cover any other costs, including but not limited to compensation for direct or indirect damage caused by defective equipment or other facilities of the photovoltaic system, loss of power during product downtime, or other financial consequential loss.

3.3.   If an Emaldo Product is sold in one country but installed in a different country, the warranty is void unless a written confirmation / approval been provided by Emaldo prior to installation.

3.4.   If commissioning checklist has not been filled out or is filled out incorrectly during installation, either through the installer app or using the Emaldo standard commissioning checklist template, the warranty may be voided, and Emaldo will not be responsible for any resulting issues or damages.

3.5.   The following conditions may cause defects in the device but are not covered by the Emaldo Limited Warranty.

  • Normal wear and tear (including, but not limited to, battery wear and tear).
  • Any defects occurring after the expiration of the Limited Warranty Period.
  • Failure or damage due to incorrect installation or operation/maintenance performed by unauthorized installers contrary to Emaldo instructions.
  • Failure or damage due to incorrect operation (described in the relevant manuals) by end users.
  • Product modification, design change or part replacement not approved by Emaldo.
  • Failure or damage due to unforeseen circumstances, human factors or force majeure, including but not limited to stormy weather, flood, overvoltage, vermin, improper handling, misuse, neglect, fire, water, lightning or other acts of nature.
  • Vandalism, engraving, labeling, irreversible marking or contamination or theft.
  • Non-conformities with safety regulations (TR, IEC, etc.).
  • Any rust that has developed on the equipment housing due to harsh environmental conditions. Malfunction or damage caused by exposure to coastal / salt water or other aggressive atmospheric or environmental conditions without written confirmation / approval by Emaldo prior to installation.
  • Accidents and external influences.
  • Usage of any other battery other than Emaldo batteries.
  • Failure to inform Emaldo within 2 weeks of product failure.
  • Product defects due to updates to national or regional laws or regulations.
  • Failure by the customer to provide internet connection to Emaldo to perform software and firmware updates remotely when required.
  • Failure or damage caused by other factors not related to product quality problems.

3.6.   Any defect that occurs after the expiration of the warranty period, or that occurs during the warranty period but is listed in the warranty exceptions above, is referred to by Emaldo as an out-of warranty condition.

3.7.   For out-of-warranty claims, Emaldo may charge customers for on-site service, parts, labor and logistics, including any/all of the following:

  • On-Site Service Charges: hourly costs for technicians (including traveling time) to provide support, repair, maintain, install (hardware or software) and debug malfunctioning products.
  • Parts / Materials Charges: The cost of replacement parts / materials (including any shipping / handling charges that may apply).
  • Logistics costs: any costs incurred to send defective products from the user to Emaldo.

4. LIMITATION OF LIABILITY

It is the end user's sole and exclusive remedy against Emaldo, and Emaldo's exclusive liability for product defects. This limited warranty supersedes all other oral, written, (non-mandatory) statutory, contract, tort or other aspects of Emaldo, including but not limited to, to the extent permitted by applicable law, any implied conditions, warranties or other terms. However, this limited warranty neither excludes nor limits any of your legal (statutory) rights under applicable national laws.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, EMALDO IS NOT LIABLE FOR ANY LOSS, DAMAGE OR CORRUPTION OF DATA, ANY LOSS OF PROFITS, LOSS OF USE OF A PRODUCT OR FUNCTIONALITY, LOSS OF BUSINESS, LOSS OF CONTRACT, LOSS OF REVENUE OR LOSS OF ANTICIPATED SAVINGS, INCREASED COSTS OR EXPENSES OR ANY INDIRECT LIABILITY FOR LOSS OR DAMAGES, CONSEQUENTIAL OR SPECIAL, OR PUNITIVE LOSS OR DAMAGES.

To the extent permitted by applicable law, EMALDO's liability shall be limited to the purchase value of the product. The foregoing limitations shall not apply to Emaldo's gross negligence or willful misconduct, or to death or personal injury resulting from Emaldo's proven negligence.

Limited Warranty is the basic warranty promise made by Emaldo to the end user. In some countries, the end user may receive an additional warranty (at least equivalent to the manufacturer's warranty) from Emaldo's local distributor; in case of any claims in this regard, please contact the local distributor directly.
